RKS POLICIES

Deposit: A non-refundable deposit of $50 is required to secure your session for standard shoots. Shoots lasting more than an hour will require a 25% deposit.

Balance Payment: The remaining balance is due at the end of your session. We accept cash, debit and credit cards, and popular cash apps.

Rescheduling:

• Standard: One complimentary reschedule is allowed per session with at least 48 hours’ notice. The rescheduled session must occur within 30 days of the original date. Rescheduling with less than 48 hours’ notice is considered a cancellation, resulting in forfeiture of the deposit. A second reschedule also results in forfeiture of the original deposit.
• Weather-Related: If outdoor conditions are unsuitable, we’ll move to our studio, located at 1361 W. 9^th Ave., Suite#: 315, Escondido, CA  92029.
•  If In-studio doesn’t align with our creative direction, we can certainly reschedule for another time. 
• Decisions on location and weather-related rescheduling are at the photographer’s discretion.

Late Arrivals & No-Shows: Arriving late reduces shooting time. Arrivals more than 30 minutes late are considered no-shows, leading to session cancellation and forfeiture of the deposit.

Reshoots: RKS Photography will be happy to reshoot if so requested, there may be a discount for doing so if outfit and location is the same.

Refunds:  Refunds are offered if technical difficulties prevent delivery of your planned images.

Image Delivery: Unedited proofs are sent for your inspection via an online gallery within 24 to 48 hours of the session when your balance has been paid 

Images Availability:Online for 30 days after the posting date. 

Retouched, high-resolution images are delivered as soon as you select and/or pay for any additional images or services requested.

 Proofs are not included in the package but can sometimes be purchased as an add-on with certain usage restrictions.

Image Archiving: While we do maintain an extensive archive of certain photos, we cannot guarantee any of your images will remain on file more than 1 week after your download. 

Digital Images: are subject to loss and corruption. Please be sure to back up your images to at least one external hard drive and/or cloud service immediately.

Prints:RKS Photography can help you arrange prints, or deliver for you the best quality physical prints possible, that will last the test of time.

Usage Rights: You are purchasing our expertise and a license to use your images for a specified time and manner, typically for professional use. RKS Photography retains ownership and copyright of our images indefinitely –

Professional Use Definition: Our images may be used for SELF PROMOTION on comp cards, headshots, websites, social media, casting network profiles, agency profile pages, show programs, marketing materials, and your employer’s website and social media (if applicable). 

Our Images may NOT be SOLD or used in any venue where you are directly compensated for the publication of our copyrighted images.

Creative Aesthetics: Our photographer, Richard, has a distinct shooting style reflected in our portfolio and promotional material. If you’re seeking a different style, it may be best to work with another photographer. We can advise and recommend upon request 😉 

Retouching:  Covers technical improvements, also removal of stray hairs and non-permanent skin marks (e.g. mild acne), and some enhancement of eyes and skin. Additional retouching incurs an extra fee. We will not greatly alter your face or distort your body or face in any way.

Makeup: We recommend hiring a hair stylist and makeup artist experienced in makeup for flash photography. 

Youth Clients: A parent or guardian must be present for all shoots with clients under 18 years of age.

Social Media: You may post your final images on social media. Please do not screenshot or post unedited proofs.

Model Release: By working with us, you grant us the right to use and publish our photographs in any media form for purposes including publicity, illustration, advertising, etc. If you prefer your photos not be used on social media, please inform us, at the time of shooting.

Liability: If we cannot conduct your session due to unforeseen circumstances (e.g., fire, illness, emergency), we will return your deposit without further liability. This limitation also applies if photographic materials are damaged or lost without fault on our part. 

All clients release RKS Photography and all affiliated persons and location owners from any liability, injury, or damage that may occur during the photo shoot.
